Challenges to the Employment Court where the Employment Relations Authority awarded compensation*

Vice-Chancellor University of Auckland v Panoho unreported, Colgan CJ, 3 Sep 2008, AC 29/08 – The Authority awarded $25,000 compensation for a successful unjustified dismissal claim.  With consent of the parties the Employment Court set aside the Authority’s determination.  The parties executed a confidential agreement settling the Vice-Chancellor of the University of Auckland’s challenge.  (Authority determination: L Robinson, 24 Apr 2008, AA 153/08.  Included in Jan-Jun 2008 Compensation Table)

Arthur D Riley and Co Ltd v Wood unreported, Shaw J, 8 Oct 2008, WC 18/08 – The Authority awarded $12,000 compensation reduced to $9,000 for a successful unjustified dismissal claim.  The employer’s challenge to the Authority’s determination was successful.  The Authority’s compensation award was therefore set aside.  (Authority determination: D Asher, 9 Jul 2007, WA 96/07.  Included in 2007 Compensation Table)

Air Nelson Ltd v Neill unreported, Couch J, 28 Oct 2008, CC 15/08 – The Authority awarded $5,000 compensation for a successful unjustified disadvantage claim.  The employer’s challenge to the Authority’s determination was successful.  The Authority’s compensation award was therefore set aside.  (Authority determination: P Montgomery, 25 July 2007, CA 86/07.  Included in 2007 Compensation Table)
