Tokona v Bridgeman Concrete Ltd

31 Aug 2007, M Urlich, AA 270/07, (2 pages)

PARENTAL LEAVE - Matter heard on papers - Earlier determination found applicant unreasonably directed to take parental leave early and consultation meeting too late because parental leave had commenced - Leave had been granted to claim remedies for procedural flaws - Additional information showed applicant continued working for a week after meeting, and received wages and paid parental leave entitlement for it - Given meeting held during continued employment, was real opportunity for consultation about commencement of paid parental leave - No grounds for personal grievance

Result: Application dismissed
